The Patients’ Right to Know Act

HF 522 / SF 963

Chief Authors: Senator Lindsey Port (SD56), Representative Kelly Morrison (HD 33B)

Description: The Patients’ Right To Know Act gives healthcare providers the right to provide medically-accurate, evidence-based information to their patients without interference from lawmakers. The bill repeals current laws, and prohibits future laws, that require healthcare providers to give medically-inaccurate and/or irrelevant information to patients before they receive healthcare—including abortion care.

Background: Abortion care is the only healthcare that politicians have singled out in law for biased treatment. Current law mandates doctors read a script that includes medically-irrelevant and inaccurate information, like suggesting a false link between abortion and breast cancer, to patients before they receive care. Even if a doctor believes the information may cause harm to the patient, the doctor could lose their license and be subject to felony penalties if they do not follow the script. Doctors already counsel patients and obtain informed consent based on the risks and benefits of the treatment. Abortion is the only medical procedure about which lawmakers have mandated exactly what doctors must tell their patients.

UnRestrict Minnesota is a multi-racial coalition of cross-sector organizations working to protect, expand, and destigmatize access to abortion care—and all reproductive healthcare—in Minnesota through public education, advocacy, and the law.

UnRestrict Minnesota’s vision is to achieve full reproductive justice in Minnesota, where every person has the ability to decide if, when, and how to become a parent, raise healthy children in safe and thriving communities, and have gender and bodily autonomy.
